By becoming a user of GetStudentsJapan.com, one must agree to all of the terms and conditions below. (GetStudentsJapan.com and Shaberitai.com are the property of Shaberitai Inc. and all references to any parts of this company will be referred to as GetStudentsJapan.com for the rest of this document.) Any violation of any part of this agreement by the user may result in removal from the site or any other disciplinary action that GetStudentsJapan.com sees fit. GetStudentsJapan.com claims the right to alter or amend any of the terms within this agreement as we see fit at any given time. If changes are made, such amendments will be posted below and go into effect the moment they have been posted. It is the user's responsibility to remain aware of any such changes and follow them accordingly. 

GetStudentsJapan.com provides 5 different services:

The terms and conditions of each service and their uses are laid out below in descending order. Above the individual service sections, there is a set of general rules for overall use of the site. This section is denoted: A. General Use.

A. General Use

1.     GetStudentsJapan.com is an internet based educational service with predefined appropriate uses. GetStudentsJapan.com cannot and will not be held responsible for any misconduct or misuse of the site or any of its services by any user at any time for any reason including but not restricted to accidents, criminal activity, acts of God, damage, loss, sexual harassment or abuses of any kind or any behavior considered unprofessional. GetStudentsJapan.com takes no responsibility for such actions or the repercussions of such actions. This is not a dating service or a matching service of any kind, and the use of this site for such purposes is strictly forbidden.

2.     Anyone who chooses to use the services provided by GetStudentsJapan.com chooses to do so at their own risk. GetStudentsJapan.com, nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors will be held liable to anyone for any loss, injury or damages of absolutely any kind including but not limited to the following: direct, indirect, incidental, accidental, consequential, special or punitive that are in any way related to use of, or access to this or any other service provided by GetStudentsJapan.com.

3.     GetStudentsJapan.com's user services are only available to those who currently legally reside in Japan and are of at least 18 years of age.

4.     All of the GetStudentsJapan.com user profiles must be accurate and contain a truthful description of the user and anything related as such. Any file or information that is found to contain falsified information or information that is found to be untrue will be removed from the service and said information will be stored in such a way as to prevent re-registration of said user using a different account.

5.     All registered user information is the property of GetStudentsJapan.com. GetStudentsJapan.com reserves the right to use this information as it chooses.

6.     No responsibility will be taken by GetStudentsJapan.com for technical, web-site, or server problems. GetStudentsJapan.com will attempt to resolve any difficulties as prudently as possible. No responsibility will be taken by GetStudentsJapan.com for any disclosure of information to or from third-party members or any damages incurred or problems that occur therein.  No compensation will be given.

7.     All materials which are used and displayed by GetStudentsJapan.com which include any and all of the following but are not only limited to: software, graphics, illustrations, artwork, video, music and sound, text, names, logos, trademarks and service marks are the legal property of GetStudentsJapan.com and its affiliates and/or partner sites.

8.     Any information posted, collected, transmitted or received by GetStudentsJapan.com will be considered non-confidential and non-proprietary. As such, users assume full responsibility for such information and grant GetStudentsJapan.com and all of its affiliated companies the right to edit, publish, copy and distribute such information for any purpose.

9.     GetStudentsJapan.com and its affiliates will not be held responsible for the content from any websites linked to GetStudentsJapan.com or any  such sub-sites or connected sites affiliated with GetStudentsJapan.com.

10.    GetStudentsJapan.com reserves the right to remove the profile of any user at any time for any reason. 

B. Language Teacher Service

1.     The Language Teacher Service is simply a service to match customers with Language Teachers. Schedules, lesson plans, curriculum and all other tools must be provided by the Language Teacher.

2.     Language Teachers must teach their native language or any language that they have qualifications or are certified to teach.

3.     Language Teachers are not considered to be employees of GetStudentsJapan.com and hence will not ever receive monetary payment from GetStudentsJapan.com. Lesson schedules, as well as methods of payment must be decided between the Language Teacher and the customer. 

4.     Language Teachers are also responsible for their own actions and the consequences of such actions. GetStudentsJapan.com takes no responsibility for the actions of Language Teachers or customers or any of the consequences thereof.

5.     The Language Teacher is obligated to be punctual, respectful and behave in accordance with common social standards of politeness and decorum.

6.    The minimum charge for this service is 3000 yen an hour and the maximum is 5000 yen an hour. Within these guidelines, the price is to be set by the Language Teacher.

C. Business Language Teacher Service

1.     Rules 1, 2, 3, 4 and 5 of Service B, the Language Teacher Service, also apply to Service C, the Business Language Teacher Service.

2.     Business protocol and language related lessons must be created by the Business Language Teacher, unless specifically stated otherwise by GetStudentsJapan.com. All teaching materials must be provided by the Business Language Teacher unless specifically stated otherwise by GetStudentsJapan.com.

D. Speaking Partner Service

1.     Rules 4 and 5 of Service B, the Language Teacher Service, also apply to Service D, the Speaking Partner Service.

2.     The payment for meeting with a Speaking Partner is set by GetStudentsJapan.com at 2000 yen per hour and this will not change under any circumstance except lateness (explained in rules 6 and 9 of this section).

3.     GetStudentsJapan.com exists to introduce customers to a different Speaking Partner for each meeting, in as such, GetStudentsJapan.com is not a service used to build any type of business or personal relationship between said parties and GetStudentsJapan.com will not be held responsible for the actions of the Speaking Partners or the customers outside of the confines of the service (a one time, predetermined meeting in a preset, controlled meeting place etc…) provided by GetStudentsJapan.com.

4.     If the Speaking Partner misses a meeting or cancels within 24 hours of that meeting, the Speaking Partner must reschedule with the same customer within the next 7 days and meet them for free. This is responsibility of the Speaking Partner. Failure to comply will result in removal and subsequent permanent banishment from GetStudentsJapan.com.

5.     If contacted fir a Speaking Partner job, the Speaking Partner reserves the right to refuse said offer.

6.     Lateness is not tolerated under any circumstances. If the Speaking Partner is up to ten minutes late for a meeting, the Speaking Partner will receive only half of the allotted fee. If the Speaking Partner is more than ten minutes late, he or she must complete the appointment for free.

7.     In the event that the customer does not show up, the Speaking Partner is required to wait at least 20 minutes from the agreed upon meeting time at the agreed upon meeting destination. Any time after that, the Speaking Partner may leave.

8.     If the customer arrives late, the starting time has been set and will not change.  Hence, if the customer is 10 minutes late, they will lose 10 minutes of meeting time and still have to pay the normal meeting fee of 2000 yen.

9.     If the customer fails to make the meeting without having canceled at least 24 hours ahead of time, a second meeting will be made. During this meeting, the customer will pay the Speaking Partner for the current meeting as well as for the missed meeting (i.e. 4000 Yen).

E. Corporate Training Service

1.     This service is only open to teachers registered to the Business Language Teacher service.

2.     This service is used specifically for training staff members of a company in the language of their choice to be used for business purposes.

3.     Each job is set under a uniquely created contract specific to that job.  The guidelines and rules of the job will be laid out in said contract.

4.     If initially contacted about a Corporate Training job, the Corporate Trainer reserves the right to refuse said job.

5.     The Corporate Trainer will be paid directly by GetStudentsJapan.com.

F. Translation Service

1.     If indicated on a user’s registration form, they may be contacted for Translation work.  Each singular Translation job is unique and the rules, guidelines and pay of each job are set by GetStudentsJapan.com.

2.     If initially contacted about a Translation job, the Translator has the right to refuse said job.

3.     Translators will be paid directly by GetStudentsJapan.com.
